Summary


The Planning and Zoning Commission has rejected a settlement that could have brought 150 townhouses to 42 acres off Middletown Avenue and Half Mile Road.

Instead, a town appeal before the state Supreme Court will continue. The town is appealing to the high court following decisions by the Superior and Appellate courts that paved the way for CMB Capital Appreciation to build 396 units in several high- rise buildings. The Appellate Court ruled against the town in October 2010.
