Summary
The state Freedom of Information Commisison, for the second time in three years, has ruled in favor of local Democrat Ed Foley in a complaint alleging that the Board of Education violated the Freedom of Information Act in one of its meetings. This time, the FOI Commission found in a recent decision that the school board violated the act when it failed to adquately state the purpose of a Jan. 30 executive session to discuss allegations of sexual harassment against Athletic Director Fred Balsamo, opting to list it on the meeting notice simply as "Personnel/Legal Issue" rather than something more specific.
At the time, the board voted to go into executive session against the advice of its own lawyer, after Foley, who hosts a local access cable TV show on the Board of Education, raised the issue and told the board he didn't think the meeting notice adequately stated the purpose of the executive session as required by law.See the full content of this document
