Blumenthal Presses No Child Suit, Despite Mich. Dismissal

Summary


State Attorney General Richard Blumenthal says he will press on with his lawsuit against No Child Left Behind although a federal judge in Michigan tossed out a similar lawsuit last week. "This decision by a federal district court in Michigan is wrong and in no way legally binding on our lawsuit in Connecticut. The opinion itself is disappointing in dealing with major issues of statutory interpretation with barely a page and a half of analysis and without a single citation to any precedent in case law," Blumenthal said. "Our case is also factually different."

Blumenthal filed his lawsuit in August, calling the law an unfunded mandate, and the federal government must reply by Friday .
